Welcome to VibePlanner. By downloading, installing, or using VibePlanner ("the app"), you agree to these Terms of Service ("Terms"). The app is developed and published by Nexoitec (María Helgadóttir).

1. Acceptance of Terms

By using VibePlanner, you agree to be bound by these Terms. If you do not agree, do not use the app. We reserve the right to update these Terms at any time.

2. Description of Service

VibePlanner is a neurodiversity-friendly daily planning app that includes task management, mood tracking, a music player, AI coaching, and gamification features. The app is available in Icelandic and English. Some features require a Premium subscription.

3. Free and Premium Features

• Free: 5 daily Vibe tasks, 5 schedule events per month, 5 Jar of Awesome memories, 3 themes, ambient and nature music.
• Premium: Unlimited tasks, events, and memories. AI Vibe Coach, Focus Mode, Breathwork, Photo Journal, Future Goals, Family Sync, all 11 themes, exclusive M.DóttirMusic tracks, Stats and Heatmap, Neon Garden.

4. Subscriptions and Payments

• Monthly Premium: $5.99/month, auto-renewable.
• Annual Premium: $34.99/year, auto-renewable, with a 7-day free trial.
• Lifetime Premium: $89.99, one-time purchase.

All payments are processed by Apple through the App Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Manage subscriptions in your Apple ID settings.

5. AI Vibe Coach

The AI Vibe Coach is powered by Google's Gemini AI. It provides general motivational and planning suggestions. It is not a substitute for professional medical, psychological, or therapeutic advice. Nexoitec is not responsible for any actions taken based on AI Coach responses.

6. Music Content

VibePlanner includes original music from the M.DóttirMusic label, ambient tracks, and nature sounds. All music is licensed exclusively for use within the app. You may not extract, redistribute, or use the music outside of VibePlanner.

7. User Content

You retain ownership of all content you create in the app. By using Family Sync, you grant household members access to the specific items you choose to share.

8. Acceptable Use

• Do not reverse engineer or decompile any part of the app
• Do not use the app for any unlawful purpose
• Do not attempt to access other users' data
• Do not use the AI Coach to generate harmful or illegal content

9. Intellectual Property

VibePlanner, including its design, code, themes, animations, and music, is the intellectual property of Nexoitec. The M.DóttirMusic tracks are the property of their respective artists and licensed exclusively to VibePlanner. All rights reserved.

10. Disclaimer of Warranties

VibePlanner is provided "as is" without warranties of any kind. We do not guarantee that the app will be error-free or uninterrupted.

11. Limitation of Liability

To the maximum extent permitted by law, Nexoitec shall not be liable for any indirect, incidental, or consequential damages arising from your use of VibePlanner.

12. Privacy

Your privacy is important to us. Please review our Privacy Policy for details.

13. Termination

We reserve the right to suspend or terminate access if you violate these Terms. You may stop using the app at any time by deleting it.

14. Governing Law

These Terms are governed by the laws of Iceland. Disputes shall be resolved in the courts of Reykjavík, Iceland.
